soil errosion


Question
Behind my house they are building a complex. According to the plans the elevation of the complex should come to a very gradual slant until it is even with my yard. However, the developer did not truck away the dirt when he excavated. The complex is at least 18 inches to two feet higher than my yard. A few feet from my yard there is a steep hill until my yard. How will this effect my yard? What steps should I force them to take to alleviate the potential problems that will arise?

Hi D, There is no way to know what effect it will have. In most cases, you must accept the flow of water from your uphill neighbor, just as your downhill neighbor must accept the flow from your property. In most cases, developers cannot do anything that would cause damage to your property.  Increasing the water flow through your property usually doesn't mean damage.  Erosion may.
Document everything.  You should take before, during and after pictures just in case.
It's very hard to prove "potential problems", much easier to prove actual damage.  Jim
